L année 2012 s annonce tout aussi haute en couleurs, avec des changements législatifs à l horizon, mais aussi des développements positifs pour la SODRAC dont vous devriez profiter.</p> <p>L adoption du projet de loi C-11 s est transformée en suspense. En effet, le projet a été dévoilé le 29 septembre 2011 et a été débattu à la Chambre des communes à sept occasions au cours de l automne, et ce, sans que la deuxième lecture ne soit encore complétée.</p> <p>En décembre, la pétition mise en ligne par le regroupement Culture équitable, dont la SODRAC compte parmi les partenaires, a été envoyée aux députés qui devraient former le comité législatif C-11 chargé d étudier le projet de loi. Avec plus de 13 500 signatures, le milieu de la culture a signifié au gouvernement qu il est absolument nécessaire de revoir certains éléments du projet de loi C-11 et de préserver les droits des créateurs.</p> <p>Le plan du gouvernement conservateur d adopter rapidement le projet de loi avant les fêtes ne s'est pas réalisé, mais le processus se poursuivra dès la reprise des travaux parlementaires, le 30 janvier 2012. En plus des rencontres que nous avons déjà effectuées avec des représentants du gouvernement, nous allons continuer notre travail auprès des députés de tous les partis et du comité législatif, afin de défendre vos intérêts en tentant de préserver vos droits et vos revenus. Nous vous tiendrons au courant étape par étape de nos actions et de l évolution du processus législatif. Nous vous invitons aussi à visiter régulièrement la <a href="http://sodrac.ca/ProjetLoiC11.aspx" target="">page dédiée au projet de loi C-11</a> de notre site où nous publions les liens vers les nouvelles d intérêt.</p> <p>L année 2012 promet des développements très attendus pour les membres de la SODRAC. En effet, nos <a href="http://www.sodrac.ca/bulletins/bulletin201006/replique/replique_fr.html#t_03" target="_blank">représentations de juin 2010</a> à la Commission du droit d auteur du Canada devraient connaître leur dénouement, alors que celle-ci rendra vraisemblablement dans les prochains mois sa décision dans les deux demandes d arbitrage avec Société Radio-Canada/Canadian Broadcasting Corporation (SRC/CBC) et les dix chaînes spécialisées du Groupe Astral. Ces arbitrages auront une portée rétroactive à novembre 2008 et si la Commission reconnaît le bienfondé de nos arguments, cela pourrait se traduire par une augmentation appréciable des redevances payées par ces télédiffuseurs, autant pour la synchronisation des Suvres dans les productions internes de SRC/CBC que pour les reproductions par les télédiffuseurs.</p> <p>La SODRAC poursuit également son travail d administration des sommes payées par les <i>majors</i> dans le règlement du recours collectif canadien en matière de droits de reproduction mécaniques et audiovisuels impayés. Comme vous pourrez le lire dans la présente édition, nous avons effectué une première répartition de redevances en décembre 2011 et nous allons continuer en 2012 avec deux autres répartitions.</p> <p>Nous travaillons évidemment à bien d autres dossiers, ententes et tarifs. La SODRAC est <i>votre société</i> de gestion collective et, avec votre soutien, nous avons toujours à cSur de défendre vos droits et de maximiser vos redevances par le biais de nos relations privilégiées avec les joueurs d ici et d ailleurs. COLOR: #363636; FONT-FAMILY: Arial, Helvetica, sans-serif"> <p>Le 5 janvier 2012, suite à notre demande de licence provisoire avec le télédiffuseur ARTV, la Commission du droit d auteur du Canada a rendu une <a href="http://www.cb-cda.gc.ca/decisions/2012/20120105.pdf" target="_blank">décision</a> favorable à la SODRAC.</p> <p>Par cette décision, la Commission maintient les redevances payables et les modalités de l entente de licence à laquelle, rappelons-le, ARTV a mis fin unilatéralement en septembre 2011 et autorise ainsi ARTV à poursuivre la reproduction des Suvres du répertoire de la SODRAC.</p> <p>La Commission du droit d auteur souligne, pour appuyer sa décision, qu ARTV n a pas démontré qu une évolution justifiait de mettre fin aux modalités d utilisation du répertoire de la SODRAC qui prévalaient jusqu en septembre 2011. Cette entente couvre l ensemble des synchronisations des Suvres du répertoire de la SODRAC dans les émissions produites par <i>Productions J</i> et ses sociétés affiliées, et ce, pour le passé et pour les productions réalisées à compter de son entrée en vigueur.</p> <p>Nous vous rappelons que pour le bénéfice de ses membres, la SODRAC a créé un département qui depuis toujours assure la gestion des droits de synchronisation auprès de producteurs télévisuels, de longs métrages et de films publicitaires. L audition en vue de l homologation du tarif définitif se déroulera à compter du 9 octobre 2012.</p> <p>Les CD sont de moins en moins utilisés pour copier la musique et dans trois ans l utilisation de ce type de support sera à toutes fins pratiques chose du passé. Compte tenu des décisions des tribunaux en la matière, de la <i>Loi sur le droit d auteur</i> actuelle et de la volonté du gouvernement avec le projet de loi C-11, cela signifierait la fin des redevances pour la copie privée.</p> <p>Toutefois, les technologies évoluant, les cartes mémoire microSD sont maintenant couramment utilisées pour la reproduction des Suvres. La SODRAC et la CMRRA, qui administrent le règlement par le biais de CSI, ont réparti plus de 8 millions lors de ce premier paiement.</p> <p>Il s agit là d une première phase de répartition, puisque le paiement de l ensemble des sommes prévues par l entente se poursuivra en différentes étapes en 2012 et au cours des prochaines années. Gilles Lessard, chef de service au département des arts visuels et des métiers d art.</p> <p>D abord depuis le 1er janvier 2012 en Europe, où la Commission Européenne vient de publier un <a href="http://ec.europa.eu/internal_market/copyright/docs/resale/report_fr.pdf" target="_blank">Rapport sur la mise en Suvre et les effets de la directive « droit de suite »</a>, l ensemble des pays de l Union Européenne (UE) doivent maintenant appliquer le droit de suite pour la durée complète de protection des Suvres et non plus seulement aux ventes d Suvres d auteurs vivants. À l encontre de certaines craintes exprimées par les marchands d art, le rapport souligne qu il n est pas possible de conclure à un impact négatif du droit de suite sur les ventes en Europe.</p> <p>Par ailleurs, aux États-Unis un projet de loi sur le droit de suite (<i>resale right</i>) vient d être présenté au Congrès américain avec le soutien de nos sociétés sSurs Artists Rights Society (ARS) et Visual Artists and Galleries Association (VAGA). Le projet de loi propose d étendre à l ensemble des États-Unis le droit de suite qui existe uniquement en Californie, avec un taux de 7 % du prix de revente pour les transactions de plus de 10 000 $ effectuées par les maisons de vente aux enchères.</p> <p>Il s agit là de progrès marquants.
