Le comité d étude formé suite à l assemblée générale de juin 2008 pour étudier la gestion à la carte dans le domaine de la musique y fera rapport.</p> <p>Co-présidé par Lise Aubut (auteur) et David Murphy (éditeur), le comité d étude a consulté tant des membres auteurs et éditeurs que des intervenants de l industrie de la musique. Ses recommandations reflètent la volonté de la SODRAC d offrir à ses membres une plus grande souplesse dans la gestion de leurs droits tout en préservant les avantages de la gestion collective, qui est la base même de son action. Les recommandations touchent particulièrement le droit de synchronisation, l autoproduction et la licence directe.</p> <p>Je vous invite à prendre connaissance de l avis de convocation que vous avez reçu récemment pour notre assemblée du 26 mars à 17 h à l Hôtel InterContinental de Montréal. Notre DG a profité de l occasion pour informer le ministre de nos demandes : étendre le régime de la copie privée (actuellement limité aux CD) aux enregistreurs audionumériques et responsabiliser les fournisseurs d accès Internet en matière de téléchargement illégal. L objectif du regroupement représentant les artistes, créateurs et artisans de la musique et de l audiovisuel québécois est que le CRTC réglemente les entreprises canadiennes de nouveaux médias, à l instar des médias traditionnels, et leur impose des obligations appropriées de contribution à la culture canadienne. Le nouveau contrat qui en scelle le contenu sera signé le 24 avril prochain et entrera en vigueur le même jour. Gain significatif, l ONF paie dorénavant des redevances pour la synchronisation des oeuvres musicales de nos membres à ses productions. Les obligations contractuelles incluses dans l entente précédente sont également reconduites sans oublier que, depuis le 31 octobre dernier, une redevance est perçue sur la vente au détail de DVD de l Office. Nous soulignons le lancement de la collection des films de l ONF disponible sur son site web, une vitrine cinématographique de grande qualité. En vertu de ce tarif, seuls les membres de la SODRAC sont autorisés à recevoir de telles&nbsp;redevances au Canada. La SODRAC propose le renouvellement du tarif existant, tout en demandant que sa portée soit étendue aux copies de films destinées aux salles commerciales, ce qui serait une source de revenus tout à fait justifiée pour nos membres. Par exemple, plus de 336 sorties en salle ont été recensées au Québec en 2005 seulement. Le tarif proposé couvre les années 2009 à 2011 et une décision est prévue à la fin de 2010. Demandez aussi que ce numéro soit transmis à la SODRAC. ISAN Canada est l agence reconnue au niveau international pour l enregistrement des numéros d identification des Suvres audiovisuelles produites au Canada. Elle est en mesure d inscrire les productions canadiennes au registre central situé à Genève. Avec des formations en droit et en communication, il a Suvré dans différents organismes du secteur des arts visuels avant d occuper le poste de directeur général de la SODART, société de gestion de droit d auteur qu il a dirigée durant quatre ans. Stéphane est quant à lui bien connu de l équipe de la SODRAC, puisqu il a déjà occupé le poste d agent responsable de l émission des licences audio. Pour être admissible à ces paiements de COPIBEC, au moins une de vos Suvres doit avoir été reproduite dans un livre, un catalogue d exposition, une revue ou un journal publié au Québec entre le 1er janvier 2005 et le 31 décembre 2007.</p> <p>Il est important de déclarer toutes vos Suvres reproduites, car pour l un des deux paiements COPIBEC tiendra compte du nombre de mentions. Dans ce cadre, elle a récemment mandaté la SODRAC pour percevoir, détenir et éventuellement verser à qui de droit les redevances applicables aux utilisations des Suvres artistiques. L entente prévoit que la Commission nous transmet copie des licences qu elle émet, suite à quoi nous percevons les redevances des utilisateurs. Si les titulaires des droits peuvent être retracés ou s ils se manifestent dans un délai convenu, nous leur versons alors les sommes dues.
